Fee and Policy Schedule of My Household Managed, “MHM”

Deposit- The Client shall pay a non-refundable deposit (the “Deposit”) in the amount of $500 due upon execution and delivery of these Terms.
Balance- The Client shall pay the remaining balance (the “Balance”) upon completion of the Agency Services, which for the avoidance of doubt shall occur upon the consummation of a written Work Terms between the Household Employee and the Client or once the Candidate referred by My Household Managed accepts an offer of employment or other engagement from the Client (either a written or verbal offer). In no event shall such payment be made after the Hiring Date, in such amounts as set forth on the Agreement. If Client does not provide compensation information within 5 days of request by My Household Managed, Client agrees to be invoiced based upon the rates and hours included in the job description approved by Client.
Full-Time and Part-Time Placements- The Client agrees to be charged a Fee for the placement (“Placement Fee”) that includes the following offerings listed in Section 6. If, during the applicable Guarantee Period, the Candidate leaves the Client’s employment for any reason, considering the exceptions mentioned in Section 21, My Household Managed LLC will find a replacement candidate. Placement fees cannot be combined.
Temporary Placements- Include any position with a defined end date that is less than one year in duration. Placement fees for temporary positions are calculated using the gross annual compensation offered to the candidate in the work agreement and based upon a 52 week year. Minimum fees apply.
Live-In Placements - For live-in employee placements, separate, private accommodations for the employee must be provided. A minimum placement fee of 25% of the candidate's gross annual compensation will be applied. This reflects the comprehensive scope of responsibilities and the commitment required for live-in positions.
Placement Fee:
20% of Candidate’s Gross Annual Compensation, with a minimum fee of $5,000

Gross Annual Compensation - Includes all compensation that is legally owed pursuant to state and federal law (whether paid for by Client or not) in whatever form, including but not limited to hourly wages (including applicable overtime based on offer letter), salary, bonuses, housing and cost of living stipends or any other non-healthcare stipends received by the Candidate from Client in a typical work week multiplied by 52, or per month multiplied by 12, regardless of the duration of employment, or the lowest end of the advertised annual compensation package in the client's approved job description, whichever is higher. Providing healthcare benefits or reimbursement is an industry standard and highly recommended for domestic employees to have in place. For this reason, we do not include healthcare stipends or reimbursements when calculating total gross annual compensation.
Legal Pay- As an employer, your family is legally responsible for paying domestic employees 'on the books' or legally, as well as following the state-specific overtime laws that apply to your household.
Payment Methods- Payments shall be made to the account or accounts and in such methods as may be designated by My Household Managed. For Clients choosing to pay the Balance from a bank account, no processing rate will apply. For clients choosing to pay the Balance by credit card there will be a 3.5% processing fee upon each invoice.
Late Fees- Payments later than five (5) days after the due date are subject to a late fee equal to the greater of (i) 1.5% per month or (ii) such other interest rate as allowed by law. If the Client's payment method is declined, Client is responsible for arranging alternate payment of the invoice.
Non-Responsiveness Clause- If the Client does not respond to emails or calls from My Household Managed within 5 days after three (3) attempts from My Household Managed, My Household Managed will assume the search is no longer a priority for Client and will stop all recruitment efforts. If Client contacts My Household Managed again after 5 days and after three (3) attempts to communicate have been made and wishes to re-launch the search, Client will be required to pay an additional $500 deposit. Similarly, if the Client chooses to pause or close the search for any reason, My Household Managed will stop all recruitment efforts and if the client chooses to re-launch their search an additional $500 deposit will be required to begin the search again.
Alteration of The Job Description- Changes to hours, locations, qualifications, compensation, start date, or job responsibilities after you have approved your job description that may require us to alter our recruitment efforts, edit the job description significantly, or disqualify candidates who are currently being vetted or being considered will constitute initiating a new, unique search and an additional $500 deposit will be due. Upon launching a new search, My Household Managed will charge the payment method on file for an additional deposit. Additionally, My Household Managed reserves the right to cease work on a search if any of the above alter the position so significantly that My Household Managed no longer believes that it will be able to find suitable candidates to introduce to the Client. All deposits are earned in full at the time charged and are non-refundable. We strongly encourage the Client to have a clear understanding of the role and desired qualifications and characteristics prior to launching a search, so that we have the best possible chance of providing the Client with candidates who will be a good long-term fit.
Duration of Search - We have found that most positions experience the greatest volume of candidates during the first few weeks a position is posted. We generally say that a search will take between 4 and 6 weeks and recommend that Clients do not launch a search more than 3 months prior to their start date. After a search has been active for 90 days, if a suitable candidate has not yet been found, the Client will have the option to re-launch the search for an additional $500 deposit for an additional 90 days. Client will also have the opportunity at that time to discuss the job specifications with My Household Managed and revamp the job description if necessary. If, after 90 days, the Client elects not to re-launch the search, the position will be removed from the job boards and My Household Managed will cease recruiting candidates for the position. The Client is welcome to continue in the process with any candidates who are currently under review or in the interview, trial, or offer stage.
Trial Periods- Client may trial a My Household Managed candidate for up to 3 consecutive days, after a written offer has been presented to the Candidate, with the offer contingent upon a successful trial. Candidates are to be paid directly for their time worked and at the hourly rate advertised in the offer letter.
Work Agreements- We provide templates for work agreements between the family and Candidate for your family to complete and have reviewed by your attorney if you choose, or your family is welcome to provide or create your own agreement. My Household Managed requires having a signed copy of each agreement on file. Failure to provide a written employment agreement will void any search credits or replacement policy that otherwise would have been in effect.
Confidentiality- Client understands and agrees that, to the maximum extent allowed by law, all information provided by My Household Managed including, without limitation, job descriptions, training materials, and information or materials about Candidates are to be kept strictly confidential, are the property of My Household Managed, and are to be used only in conjunction with My Household Managed's referral services.
Previously Identified Candidates- Client understands and agrees that prior to My Household Managed beginning a search for Client, Client must provide My Household Managed with the names of any individuals whom they are considering for employment or other work engagement. Client agrees to promptly update My Household Managed about any additional individuals Client is considering for employment who were not referred by My Household Managed during the course of My Household Managed’s search(es). If My Household Managed provides Client with the name of a Household Employee candidate who Client has not previously identified to the agency and the Client hires, or otherwise engages that Household Employee candidate, Client agrees to pay My Household Managed the referral fee.
Non-Discrimination- My Household Managed believes and abides by equal opportunity employment laws and does not discriminate on candidates based on age, race, sex, sexual orientation, gender identity and/or expression, religion, creed, marital status, medical history, or any other discriminatory characteristics.
Start Date- Our guarantee period is calculated based upon the candidate's first day of employment as outlined in the signed work agreement. In instances where a client has not indicated a precise start date in the work agreement, the agency will utilize the date of the work agreement's signing to determine the first day of the guarantee period.
Termination of the Household Employee and Guarantee. The Client may, in its sole and absolute discretion, terminate the Work Terms and the Household Employee at any time for any reason permitted by applicable law and the Work Terms (the date of such termination, the “Household Employee Termination Date”).
If the Household Employee leaves the Client’s employment (the date of which, the “Household Employee Termination Date”) within the Guarantee Period, My Household Managed will, for thirty (30) days from the Household Employee Termination Date (or initiation of the replacement search, whichever is sooner), make reasonable efforts according to applicable law to provide additional referrals for a maximum of one replacement Household Employee to Client. Clients are welcome to continue the interview process through the agency with My Household Managed candidates that have been identified within the 30 day period. The Client has 30 days from the date of the Household Employee Termination Date to invoke this Guarantee with My Household Managed. Any increase in the gross annual compensation with the replacement candidate will incur a new calculation for the placement fee, with the Client's previous placement fee serving as a credit. Household Managed’s obligation to provide additional referrals is expressly conditioned on the exceptions set forth in Section 21 below. Determining compliance with such exceptions is in the sole and absolute discretion of My Household Managed. If the Client fails to satisfy all the conditions set forth herein, My Household Managed shall have no further obligations to Client. My Household Managed’s obligation to provide additional referrals shall not apply if the Household Employee gives Client notice of her or his intention to terminate her or his employment with Client at the end of the applicable Guarantee Period.
Exceptions. In no event will the Client be entitled to replacement services if the Client:
fails to pay any fees or amounts owed to My Household Managed or to the Household Employee;
attempts to make any private agreement with the candidate or takes any action which is inconsistent with this agreement, or which has the effect of avoiding any of the Client’s obligations hereunder;
fails to uphold the employer responsibilities as outlined in the work agreement;
makes material changes the job description after the Hiring Date;
decreases or increases the work hours;
changes the work schedule;
fails to first attempt to resolve any issues through training, weekly check-ins, or performance reviews;
decreases or fails to pay the salary owed to the Household Employee;
decreases employment benefits;
fails to abide by all applicable laws, including paying the Household Employee in a timely manner in full and as required by law;
relocates;
fails to satisfy all Client’s obligations under these Terms;
fails to initiate the replacement search process within thirty (30) calendar days of the Household Employee’s last day of employment;
fails to notify My Household Managed of the termination of a Household Employee within 48 hours of such termination;
fails to provide My Household Managed with a copy of any agreement between the Client and the Household Employee by the first day of employment, including any future amendments;
changes the work environment and conditions or if the Household Employee experiences immoral or criminal activities within the client’s household, up to and including harassment, bullying, disrespect, or abuse of any kind or moral turpitude
Non-Disclosure of Client Information
MHM will not disclose or share any client information, including names, addresses, or any other identifiable details, with applicants unless relevant information is necessary for the recruitment process. For example, once a client confirms an interview time with a candidate we may share the name of the individual the candidate will be meeting with for a Zoom interview OR provide the address for an in-person interview if it is to take place in the client's home.
Revision of Fees and Policies Hereunder
MHM may revise this Fee and Policy Schedule from time to time upon notice to the Client.
